Senate Concurrent Resolution 504

A CONCURRENT RESOLUTION PROPOSING AN AMENDMENT TO THE MISSISSIPPI CONSTITUTION OF 1890, TO PROVIDE FOR THE REPEAL OF SECTION 48 WHICH PROVIDES THAT LEGISLATORS SHALL BE PRIVILEGED FROM ARREST DURING THE LEGISLATIVE SESSION EXCEPT FOR CERTAIN CRIMES.

BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI, That the following amendment to the Mississippi Constitution of 1890 is proposed to the qualified electors of the state:

Repeal Section 48, Mississippi Constitution of 1890 which reads as follows:

Section 48. Senators and Representatives shall, in all cases, except treason, felony, theft, or breach of the peace, be privileged from arrest during the session of the Legislature, and for fifteen (15) days before the commencement and after the termination of each session.

BE IT FURTHER RESOLVED, That this amendment shall be submitted to the qualified electors at an election to be held on the first Tuesday after the first Monday in November 1999, as provided by Section 273 of the Constitution and by law.

BE IT FURTHER RESOLVED, That the explanation of the amendment for the ballot shall read as follows: "This proposed constitutional amendment repeals the section which provides that legislators cannot be arrested during the legislative session except for the crimes of treason, felony, theft, and breach of the peace."
